Proposition 314 was approved in the November 2024 elections. Some parts of the law have already gone into effect, but the section that allows Arizona authorities to arrest and order deportations is still suspended.

1: Entering Arizona without legal status is a crime:
Proposition 314 makes it a crime for anyone without legal immigration status to enter Arizona without permission. Arrests can take place anywhere in the state, including schools, hospitals, and churches. This can also apply to people seeking asylum and those who have been admitted to the country by the federal government. Arizona police and judges can order deportations under the law. You should know that the law will only affect people who enter without permission after the law goes into effect. If people entered before then, they cannot be charged with a crime under Proposition 314.
2:Non-citizens who apply for public benefits may be reported and penalized:
Under Proposition 314, state and local government offices that provide benefits such as Medicaid (AHCCCS), food stamps, and unemployment will be required to verify that recipients have legal immigration status. In addition, Proposition 314 makes it a crime for people without immigration status to provide false information to government agencies in order to obtain these benefits. Individuals who present false identification to their employer can also be penalized under this law.

3: More severe sentences for the sale of fentanyl:
Proposition 314 establishes stricter penalties for selling fentanyl manufactured outside the United States in Arizona.
